Court Finds NCAA Does Not Control Member Institutions in Discovery Battle

A judge overseeing the NCAA Student-Athlete Name & Likeness Litigation has ruled for the NCAA in a critical discovery dispute, finding that the NCAA is not required to compel its member institutions to turn over documents to the former college student-athletes who are bringing the lawsuit.   In sum, the court, pursuant to a straightforward analysis of Rules 33 and 34 of the Federal Rules of Civil Procedure, found that the plaintiffs “have failed to establish that the NCAA has ‘controlâ€
