Athlete Failed To Exhaust Internal Remedies Before Seeking TRO

A federal judge in the District of Nebraska has denied an athlete’s motion for a temporary restraining order against the governing body of his sport, finding that he had not exhausted all internal remedies provided by the body to clear his name after testing positive for a prohibited substance.   Matt Mitten, the director of the National Sports Law Institute at Marquette University, noted that the finding was not surprising, since “courts are only going to intervene when there is threat
