Panel: Trial Court Acted Prematurely in Negligence Case

A New York State appeals court has reversed a trial court in a negligence case, finding that the defendant school district could not have foreseen an injury that occurred to a female student, who was playing touch football during recess when the accident occurred.   The daughter of plaintiff Lenore Bellinger was a fifth grader at Wood Road Intermediate School in the Village of Ballston Spa, Saratoga County.
