Judge Dismisses Arkansas Tech’s Claim that NCAA Overstepped Its Authority in Punishing School

A federal judge from the Eastern District of Arkansas has granted the NCAA’s motion to dismiss in a case in which it was sued by the Board of Trustees of Arkansas Tech University for breach of contract and civil rights violations under 42 U.S.C. section 1983 and the Arkansas Civil Rights Act (ACRA).   In so ruling, the court agreed with the NCAA that Arkansas Tech has not shown that the NCAA violated its contract and because the NCAA is not a state actor capable of being sued under sectio
