Kentucky Appeals Court Tightens the Reigns on Coaches and Their Responsibility Around Concussions

A Kentucky appeals court has affirmed a lower court’s ruling to deny a motion to dismiss filed by a coach, who is being sued by a cheerleader for failing to recognize that the cheerleader suffered a concussion, and for failing to take appropriate steps in the aftermath of the injury.   In so ruling, the court found that Carrie Goodman, the defendant, had a ministerial duty to protect the plaintiff, rather than a discretionary one as argued by Goodman.   Goodman was employed as a teac
