Hey! Hey! Can We Pray? Cheerleader Case Won’t Go Away

Without addressing the substantive issues, the Supreme Court of Texas revived a lawsuit that had been dismissed as moot by the Court of Appeals for the 9th District of Texas (Matthews v. Kountze Independent School District, NO. 09-13-00251-CV). In deciding that the school district’s conduct might reasonably be expected to recur, the case was remanded back to the Court of Appeals for further proceedings on the merits.
The Kountze litigation was prompted by
