Pennsylvania’s Highest Court Declines to Consider NCAA Appeal

The Supreme Court of Pennsylvania has declined to hear an appeal by the NCAA, meaning a lawsuit brought by the parents of a student-athlete, who died from sickle cell trait (SCT) while playing basketball, can continue.   The decision lets stand an appeals court’s decision to reverse a lower court, which had dismissed the claim, holding that the NCAA could have only “increased the risk of harm” for the student-athlete through “an affirmative act.” The appeals court concluded that a
